1. Scope of These Terms and Conditions

Food Online Limited ("Food Online", "we", "us", or "our") is committed to providing reliable food delivery services to Users, Couriers, Partners, and other stakeholders. These Terms and Conditions govern the use of our Platform and services.

1.1 Our Commitment

We are committed to providing high-quality food delivery services while respecting all applicable laws and regulations, including the Nigeria Data Protection Regulation ("NDPR").

1.2 Possible changes and updates

We may update these Terms and Conditions from time to time. We will notify you of any changes by posting the updated Terms on our Platform and updating the "Last updated" date at the top of this document.

2. User Access and Registration

2.1 Basic Requirements for Registration

  • To use the Platform, you must be at least 18 years old and have the legal capacity to enter into a contract
  • You must provide accurate, current, and complete information during registration
  • You must maintain the security of your account and immediately notify Food Online of any unauthorized use
  • You must comply with all applicable laws and regulations
  • You must not use the Platform for any illegal or unauthorized purposes

2.2 User Profile and Responsibilities

You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.

3. Service Terms and Conditions

3.1 Service Description

Food Online provides an online platform connecting users with food delivery services. We facilitate the ordering and delivery of food from participating restaurants and food establishments.

3.2 Service Availability

Our services are available in designated areas within Nigeria. We reserve the right to modify service areas at any time based on operational needs.

3.3 Service Modifications

We may modify or discontinue any aspect of the Platform at any time without prior notice.

4. Economic Conditions

4.1 Prices and Payments

All prices are displayed in Naira (₦) and include applicable taxes. Prices are subject to change without notice. The final price may vary based on delivery location and other factors.

4.2 Payment Methods

  • We accept various payment methods including credit/debit cards, bank transfers, and mobile money
  • Payment must be made in full before delivery
  • We reserve the right to refuse any payment method at our discretion
  • Payment processing is handled by our authorized payment service providers

4.3 Refunds

Refunds will be processed within 7 business days of cancellation or return. Refunds will be made using the same payment method used for the original purchase. Refunds may be subject to certain conditions and fees.

5. Order Terms

5.1 Order Placement

Orders can be placed through our Platform. Orders are subject to acceptance by the food establishment and availability of items. We reserve the right to reject any order at our discretion.

5.2 Order Cancellation

Orders can be cancelled free of charge before they are picked up by the courier. No refunds will be issued for cancelled orders that have been picked up or are in transit.

5.3 Order Modification

Orders cannot be modified once they have been confirmed by the food establishment. Any modifications must be requested before order confirmation.

6. Delivery Terms

6.1 Delivery Area

Delivery is available within specified areas. Delivery times may vary based on location and order volume. We reserve the right to modify delivery areas at any time.

6.2 Delivery Restrictions

  • Certain items may not be delivered through Food Online, including but not limited to: alcoholic beverages, prescription medications, and age-restricted products
  • We reserve the right to refuse delivery to certain locations or addresses
  • Delivery times are estimates and not guaranteed
  • We are not responsible for delays caused by circumstances beyond our control

7. User Responsibilities

7.1 General Obligations

  • Use the Platform only for personal, non-commercial purposes
  • Not use the Platform to send spam or unsolicited communications
  • Not interfere with or disrupt the Platform or its servers
  • Not attempt to gain unauthorized access to the Platform or its related systems or networks
  • Not use the Platform for any illegal or unauthorized purposes
  • Comply with all applicable laws and regulations

7.2 Account Security

You are responsible for maintaining the security of your account and immediately notifying Food Online of any unauthorized use.

8. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of Food Online or its content suppliers and is protected by Nigerian and international copyright laws.

8.1 User Content

You retain all rights to content you submit to the Platform. However, by submitting content, you grant Food Online a non-exclusive, worldwide, royalty-free license to use, modify, and distribute the content in connection with the Platform.

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nigeria. Any disputes arising out of or in connection with these Terms shall be resolved through Nigerian courts.
